These Terms and Conditions (“Terms”) govern the relationship between Lift Ease Pty Ltd ABN 64 689 763 335 (“Lift Ease”, “we”, “us”, or “our”) and any individual, company, or entity (“Client”, “you”, or “your”) that accesses our website, requests a quote, receives an invoice or letter of offer, or engages our products and/or services in any capacity.
These Terms apply to all Quotes, Invoices, Letters of Offer, and any engagement with Lift Ease unless expressly superseded by a signed Sales Contract or Service Agreement. Where these Terms conflict with a signed Sales Contract or Service Agreement, the Sales Contract or Service Agreement will prevail to the extent of the inconsistency.
Lift Ease reserves the right to update, amend, or replace these Terms at any time without prior notice. The current version is published on our website and takes effect from the date of publication.
By accessing the Lift Ease website, requesting a quote, accepting a letter of offer, making payment, or signing any related document, you acknowledge that you have read, understood, and agree to be bound by these Terms in their current form.

2. Website Use
This website is provided for general information and marketing purposes only. By accessing or using this website, you agree not to misuse, interfere with, or attempt unauthorised access to any part of the website or its systems. Lift Ease reserves the right to update, modify, or remove content at any time without notice. While Lift Ease endeavours to ensure the information on its website is accurate and current, we make no representations or warranties about the completeness, accuracy, or currency of that information. Website content does not constitute legal, financial, engineering, structural, or professional advice and does not form part of any binding contract unless expressly incorporated into a signed Sales Contract or Service Agreement. This website may contain links to third-party websites for convenience only. Lift Ease does not control or endorse such websites and accepts no responsibility or liability for their content, accuracy, or use. Lift Ease does not guarantee uninterrupted or error-free access to the website and accepts no liability for website downtime, technical errors, or loss of data arising from website use.
3. Intellectual Property
All content on this website and in any materials produced by Lift Ease, including but not limited to text, images, logos, drawings, designs, specifications, and software, is the property of Lift Ease or its licensors and is protected under applicable intellectual property laws. No content may be reproduced, distributed, modified, or used without prior written consent from Lift Ease. The Client is granted a limited, non-exclusive, non-transferable licence to use any deliverables provided by Lift Ease solely for the Client’s internal business purposes. Specific intellectual property ownership and licensing provisions for bespoke projects are addressed in the relevant Sales Contract or Service Agreement.
4. Media, Marketing and Project Use
By engaging Lift Ease for any products or services, you grant Lift Ease a perpetual, irrevocable, royalty-free right to photograph, video, and otherwise capture the works, installations, and project outcomes. Lift Ease may use this material for marketing, advertising, portfolio, website, and promotional purposes without further consent or compensation, provided no personal identifying information is disclosed without permission.
5. Product Information and No Guarantees
All product descriptions, specifications, images, performance data, and representations are provided as a general guide only and may vary from the final delivered product. To the maximum extent permitted by law, Lift Ease makes no guarantees, warranties, or representations (express or implied) regarding performance, suitability, timelines, outcomes, or fitness for a particular purpose, except where required under Australian Consumer Law. Any advice or recommendations provided by Lift Ease are based on information available at the time and do not constitute engineering, structural, or legal advice. Final responsibility for site suitability, structural adequacy, and compliance with all applicable laws and regulations remains with the Client and their appointed consultants.
6. Quotations
6.1 Validity All Quotes issued by Lift Ease are valid for 30 calendar days from the date of issue, unless an alternative validity period is expressly stated in the Quote document. Upon expiry, a Quote is no longer binding on Lift Ease and pricing, availability, or scope may change. Clients wishing to proceed after expiry must request a revised Quote.
6.2 Acceptance
Acceptance of a Quote must be made in writing (including by email confirmation or electronic signature) prior to the expiry date. Verbal acceptance alone does not constitute a binding agreement. Acceptance via email, electronic signature, or any digital platform constitutes legally binding acceptance of the terms.
6.3 Pricing and GST
Unless otherwise stated, all prices in Quotes are exclusive of GST. GST will be added where applicable. Lift Ease reserves the right to withdraw or amend a Quote at any time prior to acceptance by the Client, including in cases where costs, materials, or circumstances have materially changed.
6.4 Reference to Sales Contract
All supply, installation, warranty, and payment terms are governed strictly by the Lift Ease Sales Contract issued at the time of order. In the event of any inconsistency, the Sales Contract prevails over any Quote, website content, or prior communication. For detailed project-specific scope, variations, and deliverable specifications, please refer to your Sales Contract or Service Agreement.
7. Letters of Offer
Letters of Offer issued by Lift Ease are valid for 7 calendar days from the date of issue, unless an alternative period is expressly stated within the offer document. Due to the time-sensitive nature of Letters of Offer, Clients must communicate acceptance clearly and in writing within the validity period. Failure to do so will result in the offer lapsing automatically. Lift Ease may, at its sole discretion, extend the validity of a Letter of Offer upon written request by the Client, but is under no obligation to do so. A lapsed Letter of Offer does not guarantee the same terms will be available upon reissue. Revised terms, pricing, and conditions may apply. Acceptance of a Letter of Offer binds the Client to the terms of that offer together with these Terms and creates a binding agreement pending execution of the relevant Sales Contract or Service Agreement where applicable. Specific obligations, warranty provisions, and performance guarantees arising from a Letter of Offer are governed by the Sales Contract or Service Agreement executed between the parties.
8. Price Variations, Surcharges and Additional Charges
Lift Ease reserves the right to adjust pricing, issue additional invoices, or vary costs at any time prior to and during project execution due to factors beyond its control, including but not limited to currency fluctuations, supplier price increases, freight or shipping cost increases, fuel price changes, labour cost increases, material shortages, global supply disruptions, government charges, tariffs, duties, war or conflict surcharges, pandemics, transport disruptions, or any other unforeseen circumstances. Any such additional costs will be payable by the Client.
9. Variations to Scope
Any variation to the agreed scope of works, including but not limited to changes in dimensions, finishes, specifications, site conditions, access, structural requirements, or customer-requested changes, will be treated as a variation and may result in additional charges and revised timelines. Variations must be agreed in writing before implementation. Lift Ease is not obligated to perform additional work outside the agreed scope unless a Variation Order has been accepted and signed by both parties. Specific variation procedures are set out in your Sales Contract or Service Agreement.
10. Invoicing and Payment
10.1 Invoice Issuance Lift Ease will issue Invoices in accordance with the agreed payment schedule set out in the relevant Quote, Sales Contract, or Service Agreement. Where no payment schedule has been specified, Invoices are payable within 14 calendar days from the date of issue.
10.2 Payment Methods
Lift Ease accepts payment via Electronic Funds Transfer (EFT), credit card (surcharges may apply), BPAY (where available), cheque (payment is not deemed received until cleared funds are confirmed), and other methods as agreed in writing by Lift Ease.
10.3 GST and Taxes
All Invoice amounts are inclusive of GST unless otherwise expressly stated. Clients are responsible for any applicable stamp duty, withholding tax, or other government-imposed charges.
10.4 Deposits and Non-Refundable Payments
All payments, including deposits, are strictly non-refundable once paid, as Lift Ease incurs administrative, procurement, allocation, and opportunity costs immediately upon engagement, except where required under Australian Consumer Law. Specific payment milestones and deposit terms are set out in the Sales Contract.
10.5 Disputed Invoices
If a Client disputes an Invoice or any portion thereof, they must notify Lift Ease in writing within 7 calendar days of the Invoice date, providing clear reasons for the dispute. Undisputed amounts remain payable by the Due Date regardless of any dispute. Lift Ease will investigate all disputes in good faith and seek to resolve them promptly.
10.6 Suspension of Works
Lift Ease reserves the right to suspend the delivery of goods, services, or any ongoing work without liability where any Invoice is overdue by more than 14 calendar days and no satisfactory payment arrangement has been made. Suspension does not relieve the Client of their obligation to pay all amounts owing.
11. Overdue Invoices, Interest and Debt Recovery
11.1 Interest on Overdue Amounts If an Invoice is not paid in full by the Due Date, Lift Ease reserves the right to charge interest on the outstanding balance at a rate of 10% per annum calculated daily, or the maximum rate permitted under applicable law, whichever is lower. Interest accrues from the day immediately following the Due Date until the date full payment is received.
11.2 Late Payment Fee
In addition to accrued interest, Lift Ease may apply a fixed late payment fee of $50.00 per Invoice when the Invoice becomes overdue, and again every 30 days thereafter that the Invoice remains unpaid, to cover internal administration costs.
11.3 Debt Collection and Recovery Costs
Where an Invoice remains unpaid for more than 30 days from the Due Date, Lift Ease may refer the outstanding debt to a third-party collection agency or commence legal proceedings. The Client agrees to be liable for all outstanding principal amounts plus accrued interest, all late payment fees, all debt collection agency fees and commissions, all reasonable legal costs on a solicitor-client basis, and any court filing fees or disbursements associated with recovery proceedings.
11.4 Credit Reporting
Lift Ease reserves the right to report overdue accounts to credit reporting bodies in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Clients will be notified in writing prior to any such report being made.
12. Cancellations
Once an order is confirmed, the Client may not cancel without prior written consent from Lift Ease. Any approved cancellation may incur charges including administrative, design, procurement, restocking, and loss of allocation costs, as determined by Lift Ease at its sole discretion. Where cancellation is approved prior to commencement of works, a cancellation fee of up to 15% of the total contract value may apply. Where works have commenced, the Client is liable for all costs incurred to the date of cancellation, including labour, materials ordered or procured, and any third-party subcontractor costs. Deposits paid are non-refundable unless otherwise agreed in writing by Lift Ease.
13. Delivery, Installation and Timeframes
Any delivery or installation timeframes provided by Lift Ease are estimates only and are subject to manufacturing schedules, shipping timelines, customs clearance, site readiness, and third-party factors. Lift Ease provides no guarantees regarding timing and is not liable for delays beyond its reasonable control. Risk in goods passes to the Client upon delivery to the nominated delivery address, storage on site, or handover, whichever occurs first. Title to and ownership of goods does not pass to the Client until full payment has been received in cleared funds. Lift Ease retains the right to repossess unpaid goods where payment is not received.
14. Site Readiness, Access and Delay Costs
The Client is responsible for ensuring all site conditions, including shaft construction, structural works, electrical supply, and access, are completed in accordance with Lift Ease specifications prior to installation. If installation cannot proceed due to site readiness issues, access limitations, or delays caused by third parties, Lift Ease reserves the right to charge standby time, re-attendance fees, rescheduling costs, and any associated expenses. If goods are ready for delivery but cannot be installed due to Client or site delays, Lift Ease reserves the right to charge storage, handling, and re-delivery fees until installation can proceed.
15. Customer and Third-Party Responsibilities
All electrical works, structural works, builder’s works, and any other works not expressly included in the Sales Contract remain the responsibility of the Client or their appointed contractors. Lift Ease is not liable for delays, defects, or compliance issues arising from third-party works. Lift Ease reserves the right to engage subcontractors, agents, or third-party service providers to carry out any part of the works, including installation, servicing, and commissioning, without prior notice to the Client.
16. Practical Completion, Handover and Defects
Practical Completion occurs when the lift is installed, operational, and ready for normal use, subject to minor defects that do not materially affect operation. Upon Practical Completion, the lift will be deemed accepted by the Client. Any defects must be reported in writing within 7 days of handover. Lift Ease will rectify valid defects within a reasonable timeframe. Failure to notify defects within this period constitutes acceptance of the works as complete and satisfactory, subject to rights under Australian Consumer Law.
17. Compliance and Certification
Lift Ease designs and installs products in accordance with applicable Australian Standards, including the AS 1735 series, and relevant regulations. Certification and documentation will be provided where applicable; however, final approval and compliance may depend on site conditions and third-party works beyond Lift Ease’s control.
18. Warranty
All warranty terms, inclusions, exclusions, and obligations are strictly governed by the Sales Contract provided at the time of purchase. Website statements and these Terms are for general guidance only and do not form part of any binding warranty. Warranty coverage is conditional upon compliance with servicing and maintenance requirements and may be void where unauthorised work, misuse, or neglect occurs. For all warranty-specific matters, refer to your Sales Contract or Service Agreement.
19. Privacy, Communications and Marketing
By submitting your details to Lift Ease, you consent to the collection, storage, and use of your personal information for the purpose of responding to enquiries, providing quotations, and delivering product or service information. Lift Ease may contact you via phone, email, SMS, or other communication methods and may send marketing communications in accordance with the Spam Act 2003 (Cth). You may opt out at any time using unsubscribe mechanisms provided. Personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. A separate Privacy Policy applies and is available on request or via the Lift Ease website.
20. Limitation of Liability and Indemnity
20.1 Australian Consumer Law Nothing in these Terms excludes, restricts, or modifies any right or remedy that a consumer may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including guarantees as to acceptable quality, fitness for purpose, and correspondence with description.
20.2 Limitation of Liability
To the maximum extent permitted by law, Lift Ease’s total liability to the Client in respect of any claim, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the repair or replacement of the goods or services supplied and is capped at the total value of the relevant contract. Lift Ease is not liable for any indirect, incidental, consequential, special, or punitive loss or damage, including loss of revenue, loss of profit, loss of use, loss of opportunity, inconvenience, delays, or third-party costs.
20.3 Indemnity
You agree to indemnify and hold harmless Lift Ease, its directors, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your breach of these Terms; (b) misuse of goods or services provided by Lift Ease; (c) failure to comply with project requirements; or (d) any negligent or wrongful act or omission by you or your contractors.
21. Force Majeure
Lift Ease will not be liable for any delay, failure, or additional cost arising from events beyond its reasonable control, including but not limited to natural disasters, acts of God, pandemics, government restrictions, war, civil unrest, labour shortages, supply chain disruptions, transport interruptions, currency fluctuations, or any other circumstances beyond Lift Ease’s reasonable control. Lift Ease will notify the Client as soon as practicable of any such event and its expected duration. If the event continues for more than 60 days, either party may terminate the relevant agreement on written notice.
22. Confidentiality
Each party agrees to keep confidential all information disclosed by the other party in connection with these Terms or any related agreement that is designated as confidential or that ought reasonably to be regarded as confidential. This obligation does not apply to information that is or becomes publicly available other than through a breach of this clause, was independently known to the receiving party prior to disclosure, or is required to be disclosed by law, regulation, or court order. Confidentiality obligations survive termination of any business relationship between the parties.
23. Right to Refuse Service
Lift Ease reserves the right to refuse service, decline enquiries, or cancel orders at its sole discretion, at any time and without being required to provide a reason.
24. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms or any related agreement, the parties agree to first attempt to resolve the matter through good-faith negotiation. A party must give written notice of the dispute, setting out the nature and details of the matter. The parties will meet (in person or via phone or video) within 14 days of that notice to attempt resolution. If the dispute is not resolved within 30 days of the notice, either party may refer the matter to mediation through a recognised mediation body before commencing legal proceedings. Nothing in this clause prevents a party from seeking urgent injunctive or declaratory relief from a court.
25. Electronic Acceptance
You agree that acceptance of quotations, proposals, invoices, or agreements via email, electronic signature, or any digital platform constitutes legally binding acceptance of the terms contained therein and of these Terms and Conditions.
26. Amendments to These Terms
Lift Ease reserves the right to update, amend, or replace these Terms at any time without prior notice. The most current version will be published on the Lift Ease website at www.liftease.com.au and takes effect from the date of publication. Continued use of the website or continued engagement with Lift Ease following any update constitutes acceptance of the revised Terms. Where a Client is engaged under a signed Sales Contract or Service Agreement, the Terms applicable at the time of execution will govern that engagement unless updated Terms are expressly incorporated by written agreement of both parties.
27. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
28. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be severed from the remainder of these Terms, which will continue in full force and effect.
29. Entire Agreement
These Terms, together with any applicable Quote, Invoice, Letter of Offer, Sales Contract, or Service Agreement, constitute the entire agreement between the parties with respect to the subject matter and supersede all prior negotiations, representations, warranties, and understandings, whether written or oral, not expressly incorporated herein. In the event of any inconsistency, the Sales Contract or Service Agreement will prevail over these Terms.
